Assumption of Risk

I, as parent and/or legal guardian of enrolled child understand the nature of the activities involved with gymnastics/cheer/dance and his/her experience and capabilities and believe him/her to be qualified to participate in such activity. I fully understand that gymnastics/cheer/dance involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my child's actions, or in actions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releases" named below I further understand that there may be other risks either known or not known to me or no readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs and damages incurred as a result of my child's participation in gymnastics. I hereby release, discharge, covenant not to sue, and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS Excel Gymnastics, Inc., its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and , if applicable, owners and lessors or premises on which the activity takes place, ( each considered one of the " RELEASES" herein) from all liability, claims, demands, losses, or damages on the account of my child caused or alleged to have been caused in whole or in part by the negligence of the Releases or otherwise, including negligent rescue operations. I further agree that if, despite this release, I, the gymnast or anyone of the gymnast's behalf, make a claim against any of the above Releases from any litigation expenses, attorney fees, loss liability, damage or cost any Releases may incur as the result of such claim.

Release of Liability

I consent to the use by Excel Gymnastics, Inc., of any videotape, photograph, audiotape, or any other visual or audio reproduction in which I or my child may appear, including social media productions. I understand that these materials are being used for promotion of Excel Gymnastics, Inc. Such promotional activities include, but are not limited to marketing, recruitment, publicity, and general information articles. I release Excel Gymnastics, Inc., its respective coaches, instructors, employees, volunteers, other participants, sponsors, and advertisers from any liability connected with the use of my or my child's picture, video or voice recording as part of any of the above or similar activities.

Tuition Policy (Team / CXNY Cheer)

1. Tuition is broken into equal monthly payments. Each payment covers classes during the month whether there are three, four or five classes during that period.

2. Tuition is due monthly, on the First day of each month. Invoice will only be sent to those with outstanding accounts.

3. If we have not received your tuition payment by the 15th of the month, a 5% late fee will be added in your account. When mailing your payment, please take this into consideration.

4. If your credit card is declined for any reason, you will be charged a 5% declined transaction fee.

6. The fee for returned checks is $45.00

7. If you have any question or problem with your tuition, please contact us as soon as possible so we can resolve the problem promptly. PLEASE BE SURE THAT OUR OFFICE HAS A CURRENT E-MAIL ADDRESS.

Session Tuition (Recreational Gymnastics)

Tuition is the cost of each child's class for one class per week based on our Fall, Winter, Spring, and Summer sessions. Discounts are available when signing up for more than one class per session. Tuition payment is due in FULL when registering for each session.

If your credit card is declined for any reason, you will be charged a 5% declined transaction fee. If you are late in paying your account, you will be charged a 5% late fee.

Tuition for sign-ups done mid session will be prorated for that session and that session only. A $45.00 fee will be charged for returned checks. Payments should be made online through parent portal, but other options are available by contacting the office via email ([email protected]) or telephone (845-336-6706). If you withdraw from a session before it begins, you are entitled to a 50% refund or credit. If you withdraw after a session has started, no refunds or credits will be given.

Please Note:

All unpaid balance must be paid in full before you can Re-Enroll for the next Session of classes to participate even if the schedule remains the same.

Registration:

A $45 non-refundable membership/ registration fee is required per student. The registration is good for one year from the time of sign up unless you have become inactive at which time, if you return, you will be charged a re-registration fee. An auto-deduct form is to be on file for every Registrant regardless of form of payment. Payments are to be received no later than the 15th of each month for tuition, a 5% late fee will be added to your account. Tuition must be current in order to hold your child's spot in a registered class/team.

Withdrawal:

If, for any reason, you wish to withdraw your child from class, it is your responsibilityto either submit a completed withdrawal card or notify our office by letter, email, or phone call. Verbal withdrawals to your child's instructor or to another parent will not be accepted. If you do wish to withdraw, please give us the courtesy to informing us at least seven days before the end of the month so we can call the next child on the waiting list. All students will be considered enrolled and responsible for tuition until our office is notified in the above manner. Please check to see if your tuition is up to date. NO PARTIAL PAYMENT WILL BE ACCEPTED. Those who haven't informed us in writing, of their intent to withdraw, will be held responsible for the next month tuition. Refunds and credits will not be given for a contract terminated during the semester. If for any reason a parent is to cancel their child's class enrollment prior to their semester being over, the gym must receive written notification at least 2 weeks prior to a billing cycle.

Medical Emergencies

In the event of an injury or illness, I/we grant permission to any and all healthcare providers designated by Excel Gymnastics, Inc. to provide my/our child any and all necessary medical care related to the injury or illness. I/we further understand I/we will be contacted as soon as is practical as to the medical emergency and be provided with all necessary information related to the medical emergency.

Parent Video Release Agreement

I understand that I have enrolled my child or children at Excel Gymnastics Inc. located at 2314 Rt. 9 W, Saugerties, N.Y. 12477, also referred to herein as the "Children's Activity Center". The Children's Activity Center has a program whereby webcams are in use and my children are under streaming video surveillance that used for training and management purpose, in addition to, secure accessibility from the web in accordance with the terms and conditions associated with Excel Gymnastics. By my signature below, I hereby consent to the photographing of myself and/or my minor child(ren) and the recording of my voice and or that of my child(ren) named above. I agree that I have no rights to any of the video footage or photographs for any reason at any time. I also agree that I will not screenshot, copy, reproduce, alter, modify, or create derivative works from the Content and Service. I understand that unauthorized recording, duplication, or distribution of this copyrighted work is illegal. I assume full liability of all the terms outlined in this release for any family member's account activity associated with my child or children. Copyrighted work includes all web streaming and video/audio recordings. I understand that legal action can be taken against me by Children's Activity Center for such copy-right infringement. I understand that the term "photograph" as used herein encompasses still photographs, audio, and motion picture footage. Since my child/children is/are under the age of 18:
